Nord Stream 2 AG appeals against inclusion into EU Gas Directive

MOSCOW, Oct 5 (PRIME) -- Nord Stream 2 AG, the operator of Russia’s Nord Stream-2 natural gas pipeline, has filed an appeal against a decision of the Higher Regional Court of Dusseldorf not to exclude the pipeline from the E.U. Gas Directive, a company representative said in a statement on Tuesday.

“We confirm that the Nord Stream 2 company has filed an appeal against the August 25, 2021 decision of the Higher Regional Court of Dusseldorf to the Federal Court of Justice of Germany in compliance with the set terms,” the response read.

Previously, Germany's Federal Network Agency (BNA) turned down the company’s demand to free the pipeline from regulations of the E.U. Gas Directive, and it appealed to the Higher Regional Court of Dusseldorf against the decision.

The directive demands division of functions of a producer and transporter of natural gas, and that third parties, or the companies other than Russian gas giant Gazprom in this case, get access to the pipe.

The Nord Stream-2 project envisages construction of two lines of a natural gas pipeline with an annual capacity of up to 55 billion cubic meters, running from the Russian shore to Germany under the Baltic Sea. Gazprom builds the pipeline together with Germany’s Uniper and Wintershall Dea, Royal Dutch Shell, Austria’s OMV, and France’s Engie.
